Product information

Each product page is the primary source for the product’s current description, variants, price, available images and use information. Please review that page before ordering, as product availability and packaging details may change over time.

03

Our website and the technology behind it

01

Hosting platform

dailyvitalabs.com uses Shopify for its storefront and checkout infrastructure. DAILY VITA LABS manages customer communication for orders placed through this website.

02

Domain

Our official website is dailyvitalabs.com. Please check the address bar before entering order or payment details.

03

How this Legal Notice relates to our other policies

This Legal Notice sits alongside, and does not replace, our Privacy Policy, Terms of Service, Return & Refund Policy and Shipping Policy. Where this notice and another policy overlap, the more specific policy governs that particular subject.

04

Pricing, currency, taxes and how a contract is formed

We want the moment you click "buy" to be as clear as the product page you clicked it from.

Display currency

Our storefront displays the currency selected for your location where available. The currency and total payable for your order are shown at checkout before payment is submitted.

Taxes & import duties

Where required, applicable Australian GST is included in the displayed price. For orders shipped outside Australia, any local sales tax, customs duty or import fee charged by your country's border authority is your responsibility unless our checkout states otherwise for your destination.

When a contract is formed

Adding an item to your cart is not an offer to sell. A binding sale contract is formed only once we accept your order, which we confirm by email after payment is successfully processed.

Pricing errors

If a genuine pricing or listing error appears on our site, we will contact you before dispatch to offer the correct price, a substitute, or a full refund; we will never silently charge more than the price you agreed to at checkout.

Accepted payment methods

Visa, Mastercard, American Express, UnionPay, Apple Pay, Google Pay, Shop Pay and PayPal, all processed through Shopify's PCI DSS-compliant checkout. We never see or store your full card number.

Order cancellation before dispatch

You may request a cancellation by emailing support@dailyvitalabs.com before your order has shipped; once dispatched, our Return & Refund Policy applies instead.

05

Your consumer rights, by country

Nothing in this Legal Notice, our Terms of Service, or any other policy on this website limits, excludes or attempts to contract out of any consumer guarantee, warranty or right that the law of your country makes non-excludable. Where any wording elsewhere on this site could be read as doing so, the law of your country prevails and that wording does not apply to you.

Australia

Australian Consumer Law (ACL)

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law, contained in Schedule 2 of the Competition and Consumer Act 2010. You are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage; you are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Acceptable quality & fitness for purpose

Products are supplied as described on their current product pages. Your applicable consumer rights continue to apply to purchases made through this website.

Unfair contract terms

Our Terms of Service are drafted to avoid unfair contract terms under the ACL. If any clause is later found to be unfair or void, the remainder of the terms continue to apply.

Queensland registration

As a company registered and headquartered in Alexandra Hills, Queensland, we operate nationally under the federal Australian Consumer Law, which applies uniformly to all Australian states and territories.

United States

FTC Act & deceptive practices

Section 5 of the Federal Trade Commission Act prohibits unfair or deceptive acts in commerce. We describe our products, pricing and shipping timelines accurately and do not use dark patterns, hidden fees, or fake urgency claims at checkout.

Magnuson-Moss Warranty Act

Any written warranty we offer on a product is presented in plain, understandable language consistent with this federal warranty disclosure law, and does not disclaim implied warranties where the law does not permit us to.

State consumer protection statutes

Most U.S. states, including California, New York and Texas, have their own unfair and deceptive trade practices acts and implied warranty of merchantability rules. These state-level protections apply in addition to, not instead of, federal law, based on the state you are shopping from.

CAN-SPAM & TCPA

Marketing email complies with the CAN-SPAM Act, and we do not send automated marketing text messages without the consent required under the Telephone Consumer Protection Act.

United Kingdom

Consumer Rights Act 2015

Goods supplied to UK consumers must be of satisfactory quality, fit for purpose and as described. If a product develops a fault within 30 days of delivery, you are entitled to a full refund; a right to repair or replacement, and in some cases a price reduction or final refund, continues to apply beyond that period.

Consumer Contracts Regulations 2013

As a distance-selling transaction, UK consumers have a 14-day statutory right to cancel most orders for any reason, in addition to any goodwill returns period described in our Return & Refund Policy.

Digital Markets, Competition and Consumers Act 2024

We do not use fake reviews, drip pricing, or misleading urgency claims, consistent with the fair-trading provisions this Act reinforces and which are enforced by the Competition and Markets Authority (CMA).

PECR

Electronic marketing to UK consumers complies with the Privacy and Electronic Communications Regulations: consent-based, clearly attributed, and simple to opt out of.

Canada

Competition Act (federal)

Our advertising and pricing comply with the misleading advertising and deceptive marketing practices provisions of the federal Competition Act, including drip-pricing disclosure of the total price you will pay before checkout.

Provincial consumer protection legislation

Provinces such as Ontario (Consumer Protection Act, 2002), British Columbia (Business Practices and Consumer Protection Act) and Quebec (Consumer Protection Act) each provide additional implied-warranty, cancellation and internet-sale disclosure rights. The province you order from determines which provincial statute applies to your purchase.

Quebec-specific requirements

For consumers in Quebec, our Terms of Service and this Legal Notice are available in French upon request, consistent with Quebec's Charter of the French Language, and Quebec's legal warranty of quality applies to every product we sell there.

CASL

Commercial electronic messages to Canadian customers comply with Canada's Anti-Spam Legislation, including identification, consent and a working unsubscribe mechanism.

New Zealand

Consumer Guarantees Act 1993

Products sold to New Zealand consumers are guaranteed to be of acceptable quality, fit for purpose and as described. Where a failure is not minor, you may choose a repair, replacement or refund; for a minor failure, we may choose the remedy.

Fair Trading Act 1986

We do not engage in misleading or deceptive conduct, false representations, or unsubstantiated claims about our products, prices or endorsements, as prohibited by the Fair Trading Act.

Unsolicited Electronic Messages Act 2007

Marketing messages to New Zealand customers require consent, accurate sender information and a functional unsubscribe option in every message.

Overseas supplier status

We are an overseas-based retailer supplying New Zealand consumers; the Consumer Guarantees Act and Fair Trading Act nonetheless apply to goods we supply for personal, domestic or household use in New Zealand.

06

Shipping, delivery and risk

We serve customers in Australia, the United States, the United Kingdom, Canada and New Zealand. Fulfilment arrangements, delivery options and estimated delivery windows can vary by product and destination. Current details are shown at checkout and in our Shipping Policy.

Order processing

Processing begins after payment confirmation. The product page, order confirmation and checkout show the current information applicable to your order.

Processing time

Processing times may vary by product and destination. Please refer to the current information shown at checkout.

Delivery options

Available delivery options, charges and estimated delivery windows are displayed before payment is completed.

Order tracking

Where tracking is available for the selected delivery service, tracking information is provided after the order has been dispatched.

Transfer of risk

Please ensure the delivery address entered at checkout is complete and accurate. Your applicable consumer rights are not affected by this notice.

Customs & import responsibility

For deliveries outside Australia, you are responsible for compliance with your own country's import rules, and for any customs duty or import tax charged by your border authority.

07

Returns, refunds and how they interact with your statutory rights

Our Return & Refund Policy sets out our goodwill returns window and process. That policy is offered in addition to, and never instead of, the non-excludable consumer guarantees described in Section 05 above. If a product you received is faulty, not as described, or not fit for its ordinary purpose, your statutory rights apply regardless of whether our goodwill returns window has closed.

To start any return, refund or warranty claim, contact support@dailyvitalabs.com or call +61 479 095 200 with your order number and a description of the issue.

08

Intellectual property

Unless otherwise credited, the DAILY VITA LABS name, logo, product photography, written product descriptions and the overall look and feel of dailyvitalabs.com belong to DAILY VITA LABS or its licensors.

What you may not do

You may not copy, reproduce, republish, or use our product photography, written descriptions, or branding for commercial purposes without our prior written permission.

Personal use is fine

You are welcome to view, save and share individual product pages for personal, non-commercial purposes, such as showing a friend a product you are considering.

Reporting infringement

If you believe content on our site infringes your intellectual property rights, email support@dailyvitalabs.com with details and we will investigate promptly.

Third-party trademarks

Any third-party trademarks referenced on our site, such as payment method logos, belong to their respective owners and are used only to indicate compatibility or acceptance.

09

Limitation of liability

Nothing in this Legal Notice limits rights that cannot be limited under the consumer law that applies to your purchase. Where a product is not as described, please contact DAILY VITA LABS so we can review your order in line with the applicable policy and consumer law.

Website availability

We do our best to keep dailyvitalabs.com available and accurate, but we do not guarantee uninterrupted access and are not liable for temporary outages caused by our hosting provider, Shopify, or events outside our reasonable control.

Indirect loss

Subject to your non-excludable statutory rights, we are not liable for indirect, incidental or consequential loss arising from your use of our products or website, such as lost profits or lost opportunity.

Product information

Use each product in line with the current product page and packaging information. Contact us if you need help locating order or product information.

10

Third-party services we rely on

We use Shopify for our storefront and checkout, Shopify-integrated payment gateways and digital wallets to process payment, and independent carriers to ship your order. Each of these providers operates under its own terms and privacy practices, and each is contractually or legally restricted from using your information for anything beyond the service it provides to us. Further detail on data handling by these providers is available in our Privacy Policy.

11

Governing law and jurisdiction

Primary governing law; courts of Queensland have jurisdiction, alongside your rights under the Australian Consumer Law.

United States, United Kingdom, Canada & New Zealand

Where you are a consumer resident in one of these countries, any mandatory consumer-protection law of your own state, province or country that cannot be displaced by an agreed choice of law continues to apply to your purchase, in addition to Queensland law governing the balance of the contract.
