Disclaimer
Comfort products,
explained honestly.
DAILY VITA LABS sells general comfort and vehicle-interior accessories — not medical devices, not therapeutic goods, and not a substitute for professional healthcare. This page explains, in plain language, exactly what our Ergonomic Memory Foam Seat Cushion and Car Seat Cover Towels are designed to do, what they are not designed to do, and when you should speak with a qualified health professional instead of relying on a product page.
Why this page exists, and who it is for
This Medical & Health Disclaimer applies to every product listed on DAILY VITA LABS, operated by URBAN CLOTHING PTY LTD, and to every page, image, video and written description found on this website. It is provided because our range sits in the everyday comfort category — seating support and vehicle-interior textiles — a category that customers sometimes, understandably, associate with back care, posture correction or recovery from injury. We want that association to be based on accurate information, not marketing language, so we are setting out precisely what our products are, and are not, before you buy.
This disclaimer sits alongside — and does not replace — our Terms of Service, Refund Policy, Privacy Policy and Shipping Policy. Where anything on an individual product page appears to conflict with what is written here, this page takes precedence for any question about health, medical or therapeutic use.
Nothing on this page is medical advice. It is a transparency and consumer-information document, written so that a reasonable shopper in Australia, the United States, the United Kingdom, Canada or New Zealand can make an informed purchase decision and understand their rights and responsibilities before and after buying from us.
Product-by-product, in plain terms
We currently sell two products. Here is exactly what each one is designed to do, and the health-related boundaries we deliberately do not cross in how we describe it.
Not a medical device
Ergonomic Memory Foam Seat Cushion
A contoured memory-foam cushion designed to make sitting for extended periods — at a desk, in a car, or at the dining table — more comfortable, with a lumbar profile and a hollow-centre airflow channel. View the full listing on the product page.
Not a medical or hygiene device
Car Seat Cover Towels
An absorbent microfibre towel cover with a snap-button headrest closure, designed to protect vehicle upholstery from sweat and moisture after exercise, sport or outdoor activity. View the full listing on the product page.
General health & safety guidance
Both products are simple, low-risk household and automotive items. The guidance below is common sense, written out clearly rather than assumed.
Sensible use
Please do not
The health-related claims we deliberately never make
Our product photography, video content and written copy is reviewed against this list before it is published. If you ever see a health or medical claim on one of our listings that contradicts this page, please tell us — we will correct it immediately.
No cure or treatment claims
We never state or imply that a product cures, treats, heals or reverses back pain, sciatica, poor posture or any diagnosed condition.
No clinical or trial language
We do not reference clinical trials, laboratory efficacy testing, or "doctor recommended" or "physiotherapist approved" language unless we hold a genuine, verifiable endorsement on file.
No infection-control claims
Our towel cover is described as absorbent and washable — never as antimicrobial, antibacterial, sanitising or protective against illness or infection.
No urgency-based health fear
We do not use countdown timers, stock-scarcity messaging or emotive language that implies a health risk to pressure a purchase decision.
No before/after medical imagery
We do not use posture x-rays, spinal diagrams, anatomical illustrations or "before and after" pain-relief imagery that could be mistaken for clinical evidence.
No percentage or statistic claims
We do not publish unverified statistics such as "reduces back pain by X%" or "used by X% of physiotherapists" anywhere on this store.
How each market classifies our products
Every country we ship to has its own regulator and legal test for what counts as a "medical device" or "therapeutic good." We have reviewed our range against each of these tests. These summaries sit alongside, and do not replace, the consumer-guarantee information in our About Us page, and are provided for transparency, not as legal advice.
Therapeutic Goods Act 1989
Under the Therapeutic Goods Act 1989 (Cth), a "therapeutic good" is one represented as being for a therapeutic use, such as preventing, diagnosing, curing or alleviating a disease, ailment or injury. Neither the seat cushion nor the towel cover is marketed for a therapeutic use, and neither is entered on the Australian Register of Therapeutic Goods, because neither meets the legal definition of a therapeutic good.
We deliberately avoid the specific phrases the Therapeutic Goods Administration (TGA) treats as therapeutic-use indicators — including "relieves," "treats," "prevents" or "cures" paired with a named medical condition — anywhere in our product copy.
Australian Consumer Law — Misleading Conduct
Section 18 of the Australian Consumer Law prohibits conduct that is misleading or deceptive, including in relation to health benefits. Any comfort-related benefit we describe (for example, "supports a more comfortable seated posture") is written to be accurate, general and non-clinical in nature.
Product Safety Standards
Our comfort accessories are general household and automotive goods, not children's products, electrical goods or therapeutic goods, and are not subject to a mandatory Australian consumer product safety standard. We nonetheless expect our manufacturing partners to meet general safety obligations under the Australian Consumer Law at all times.
Advertising Health Claims
Health and wellbeing advertising claims in Australia are also assessed against the AANA Code of Ethics and, where relevant, the Therapeutic Goods Advertising Code. We do not make any claim that would require pre-approval, complementary-medicine substantiation, or inclusion on the therapeutic goods register.
FDA Medical Device Definition
Under the Federal Food, Drug, and Cosmetic Act, a "device" is an article intended for the diagnosis, cure, mitigation, treatment or prevention of disease, or intended to affect the structure or function of the body. Neither product is marketed for these intended uses, so neither is registered with, cleared by, or subject to premarket review by the U.S. Food and Drug Administration.
FTC Act — Section 5 & Health Claims Guidance
Our marketing is prepared in line with the Federal Trade Commission Act's prohibition on unfair or deceptive acts or practices, including the FTC's specific guidance on substantiating health-related claims. We do not publish a health benefit unless it is a general, non-clinical comfort statement we can stand behind without clinical evidence.
Textile & Flammability Rules
Our fabric-covered products are prepared in line with the Textile Fiber Products Identification Act, the FTC Care Labeling Rule, and applicable flammability requirements under the Flammable Fabrics Act for household textile items.
State Health-Claim Statutes
Individual states, including California under its Unfair Competition Law and False Advertising Law, separately prohibit unsubstantiated health claims. We apply the same non-clinical, general-comfort language nationwide rather than varying claims by state.
UK Medical Devices Regulations 2002
A "medical device" under the UK Medical Devices Regulations 2002 is intended by the manufacturer for a medical purpose, such as diagnosis, prevention, monitoring or treatment. Neither of our products is manufactured or marketed for a medical purpose, so neither carries a UKCA or CE medical-device mark and neither is registered with the Medicines and Healthcare products Regulatory Agency (MHRA).
CAP Code — Health Claims
Advertising claims in the UK, including on our website, are prepared in line with the UK Code of Non-broadcast Advertising and Direct & Promotional Marketing (the CAP Code), which requires health-related claims to be capable of objective substantiation. We do not make a claim we cannot support with a plain, non-clinical rationale.
Furniture & Furnishings Fire Safety
Seating and cushion products supplied for the UK market are considered against the Furniture and Furnishings (Fire) (Safety) Regulations 1988, and we work with our manufacturing partners to reflect the relevant labelling and material requirements for upholstered seating items.
Consumer Protection from Unfair Trading Regulations
These regulations prohibit misleading actions and omissions, including false claims about a product's health or safety benefits. Our comfort-related copy is reviewed against this standard before publication.
Food and Drugs Act & Medical Devices Regulations
Under the federal Food and Drugs Act and the Medical Devices Regulations, a device is one intended for the diagnosis, treatment, mitigation or prevention of a disease or abnormal physical condition. Neither of our products is intended, licensed or labelled for these purposes, so neither is registered with Health Canada as a licensed medical device.
Competition Act — Misleading Health Claims
The federal Competition Act prohibits materially misleading representations to the public, including performance and health claims that are not based on adequate testing. We only publish general comfort statements that require no clinical substantiation.
Textile Labelling Act
Fabric-based products such as our seat cushion cover and towel cover meet the fibre-content and care-labelling requirements of the federal Textile Labelling Act and its Regulations, including bilingual (English/French) label content where required.
Provincial Consumer Protection
Provincial legislation, such as Ontario's Consumer Protection Act, 2002, separately restricts false or misleading representations, including about a good's benefits or characteristics, in addition to federal law.
Medicines Act 1981
Products intended for a therapeutic purpose in New Zealand fall within Medsafe's regulatory scope under the Medicines Act 1981. Neither of our products is marketed for a therapeutic purpose, so neither requires Medsafe approval or notification.
Fair Trading Act 1986
We do not engage in misleading or deceptive conduct, false representations, or unsubstantiated health claims about our products, in line with the Fair Trading Act 1986, enforced by the Commerce Commission.
Consumer Guarantees Act 1993
Goods supplied to New Zealand customers must be of acceptable quality and fit for the purpose we describe. Because we describe our products as general comfort accessories only, that is the standard against which quality and fitness are assessed — not a therapeutic or medical standard.
Advertising Standards Code
Marketing claims, including any relating to comfort or wellbeing, are prepared in line with the Advertising Standards Authority's Advertising Standards Code, which requires claims to be truthful, substantiated and not misleading.
If in doubt, see a qualified health professional first
Our team can answer questions about materials, sizing, fitment and care. We are not qualified, and are not permitted under this disclaimer, to give medical advice. Please consult your general practitioner, physiotherapist, occupational therapist, pharmacist or another appropriately qualified professional if any of the following apply to you.
Please seek professional advice before or during use of our comfort products if you experience any of the following:
- Persistent, worsening or severe back, neck or joint pain
- Numbness, tingling, weakness or loss of sensation in the legs or lower body
- A diagnosed spinal, orthopaedic, neurological or circulatory condition
- Recent surgery, injury or a healing wound in the seating or contact area
- A known allergy or sensitivity to memory foam, polyurethane or microfibre fabrics
- Pressure-related skin concerns, including reduced mobility or reduced sensation
Extra care for children, pregnancy and mobility needs
Our range is designed and described for general adult use. The following groups should take particular care, or seek advice, before relying on our products.
Children
Neither product is designed, sized or tested as a children's item, a car seat, a booster seat or a child restraint device. Adult supervision is recommended if a child is nearby while either product is in use.
Pregnancy
Seating comfort and posture needs change during pregnancy. If you are pregnant, please check with your midwife, obstetrician or general practitioner before adopting a new seat cushion as part of your routine.
Reduced mobility or sensation
If you have reduced mobility, reduced sensation, or a condition affecting circulation, our general-purpose cushion is not designed to prevent pressure injuries. Please use equipment specifically prescribed for that purpose by a clinician.
Post-surgical recovery
If you are recovering from surgery involving the back, hips, pelvis or legs, follow your surgeon's or physiotherapist's seating and posture instructions ahead of any general comfort product, including ours.
What this disclaimer changes, and what it does not
This disclaimer explains the intended purpose of our products. It does not, and cannot, remove the consumer guarantees that already apply to your purchase under the law of your country.
How and when we update this disclaimer
We review this page whenever we add a new product category, change how an existing product is described, or when the regulatory position in any of our five markets changes. Material updates are reflected in the date below.
Published as a standalone Medical & Health Disclaimer page, covering the Ergonomic Memory Foam Seat Cushion and Car Seat Cover Towels, with country-specific guidance for Australia, the United States, the United Kingdom, Canada and New Zealand.
Ask us before you rely on anything health-related
If a product description, image or video anywhere on DAILY VITA LABS seems to make a health or medical claim that isn't reflected on this page, tell us. Our Queensland-based team, operating under URBAN CLOTHING PTY LTD, reviews every report.
