DAILY VITA LABS is the only retailer authorised to sell products under this brand. This page sets out how we control our own supply chain, how you can be certain a DAILY VITA LABS product is genuine, and what we — and you — can do if a counterfeit or unauthorised copy appears anywhere in the world.
Why we publish an authenticity policy
DAILY VITA LABS is a trading name of URBAN CLOTHING PTY LTD, an Australian-registered company. We are the brand owner of DAILY VITA LABS and the sole authorised seller of products carrying that name. This page explains how we protect that name, how our products move from our manufacturing partners to your door without being tampered with or substituted, and what steps you and we can take together if a counterfeit, imitation or unauthorised copy of a DAILY VITA LABS product is ever found — on our own site or anywhere else.
This policy applies to every product currently listed on this website — the Ergonomic Memory Foam Seat Cushion and Car Seat Cover Towels — and to any product we add to our range in future. It sits alongside, and does not replace, our Terms of Service, Refund Policy and About Us page.
We do not sell, repackage or resell products belonging to any other brand. We are not a marketplace and we do not host third-party sellers on this website. Every item that leaves our fulfilment network has been produced to our specification and description — nothing is substituted along the way.
How a genuine product reaches you
Authenticity is not a single check at the end — it is built into every stage between design and delivery.
Specification & design control
Every product sold under DAILY VITA LABS is developed to a specification we control — materials, dimensions, construction and labelling. We do not license our name to a third-party manufacturer to design or brand independently.
Vetted manufacturing partners
We work with a limited number of production partners who manufacture to our specification. We do not manufacture our own raw materials, and we do not claim otherwise — but we select, brief and take full responsibility for the partners we use.
Quality checks before listing
New stock is checked against our specification sheet — materials, stitching, labelling and packaging — before a batch is approved for sale. Product photography and video used on our listings is taken from genuine stock, not stock imagery of a different product.
Controlled fulfilment
Orders are packed and dispatched from our fulfilment network, which may include facilities outside Australia. Regardless of dispatch location, URBAN CLOTHING PTY LTD remains the seller of record and the party legally responsible for the authenticity of what you receive.
One point of sale
We sell exclusively through dailyvitalabs.com, operated on Shopify. We do not currently authorise any third-party retailer, wholesaler, marketplace listing or physical reseller to sell DAILY VITA LABS products on our behalf.
Authenticity notes for each product
Neither of our current products is a licensed or branded reproduction of a third party's design, so there is no separate "official" version made by someone else to be confused with. The authenticity risk we manage is narrower and specific: making sure what we describe is exactly what is manufactured, packed and shipped to you.

The only place we sell directly is our own Shopify-powered website. If you bought from a different domain, a marketplace listing, or a social media shop claiming to be DAILY VITA LABS, treat it as unverified until you contact us to confirm.

Every genuine order generates a confirmation email from support@dailyvitalabs.com referencing URBAN CLOTHING PTY LTD, ABN 78 671 782 111, with an order number you can quote to us at any time.
Match the listing description
Compare materials, dimensions, colourway and included components against the current product page. A genuine item will match; a significant, unexplained difference is worth reporting to us.

- Photographs of the product, its packaging, and any labelling or care tags
- A description of what seems different from the listing you saw
We aim to acknowledge every authenticity report within our standard 1–2 business day response window, and will let you know what action we take — including, where appropriate, a report to the relevant platform, trademark office or consumer protection authority.
Trademark, IP and consumer-protection law, by market
Counterfeiting sits at the intersection of trademark law and consumer protection law. Below is how each market we ship to addresses both, and how it applies to the way we sell. These summaries are provided for transparency and general information, and are not a substitute for independent legal advice.
Trade Marks Act 1995
DAILY VITA LABS is used by URBAN CLOTHING PTY LTD as a trading name under which our goods are sold. The Trade Marks Act 1995 (Cth) protects registered trade marks from unauthorised use on identical or similar goods, and provides the legal basis for us to act against anyone who sells counterfeit goods under our name.
Australian Consumer Law
Sections 18 and 29 of the Australian Consumer Law prohibit misleading conduct and false representations about the standard, quality or origin of goods. Selling a counterfeit or materially different product to what was described would breach these provisions, and consumer guarantees under the ACL apply regardless of where a product was purchased from us.
Border & Customs Protection
The Notice of Objection scheme administered through the Australian Border Force allows a trade mark owner to have suspected counterfeit imports seized at the border. We may use this mechanism if we identify an import shipment of counterfeit goods bearing our name.
Criminal Counterfeiting Offences
The Trade Marks Act 1995 also creates criminal offences for the wilful sale or manufacture of counterfeit goods, enforceable in addition to civil remedies. Suspected large-scale counterfeiting can be reported to the ACCC or state police.
Lanham Act (15 U.S.C. §1051 et seq.)
The federal Lanham Act protects our trading name and branding from use by others on similar goods in a way that is likely to cause confusion. It gives us the ability to pursue civil action against a seller passing off goods as DAILY VITA LABS product without authorisation.
Trademark Counterfeiting Act of 1984
This federal statute makes the intentional trafficking of goods under a counterfeit mark a criminal offence, separate from civil trademark infringement remedies, and allows for seizure of counterfeit goods.
FTC Act — Section 5
The Federal Trade Commission Act prohibits unfair or deceptive acts or practices, including selling a materially different product from the one advertised. This applies to us directly, and would also apply to any unauthorised third party misrepresenting our goods.
U.S. Customs & Border Protection
Trademark owners can record their marks with U.S. Customs and Border Protection to help intercept counterfeit imports before they reach consumers. We monitor for signs of this activity affecting our name.
Trade Marks Act 1994
This Act protects registered trade marks from unauthorised use, and provides civil remedies against anyone selling counterfeit goods under a protected name in the United Kingdom.
Trade Marks Act 1994, s.92 — Criminal Offences
Section 92 makes it a criminal offence to apply a sign identical or similar to a registered trade mark to goods without authorisation, or to sell or distribute such goods. This can be enforced by Trading Standards.
Consumer Protection from Unfair Trading Regulations 2008
These regulations prohibit misleading actions, including selling counterfeit or materially different goods from those described. They apply to us directly and to any unauthorised reseller operating in the UK market.
Border Enforcement
Trade mark owners can apply for Border Force action against suspected counterfeit imports entering the UK, using the Intellectual Property Office's enforcement notice process.
Trademarks Act, R.S.C. 1985
The federal Trademarks Act protects registered and unregistered trade marks used in the course of trade, and provides civil remedies against passing off and infringement.
Combating Counterfeit Products Act
This Act introduced criminal offences for trafficking in counterfeit goods and gave the Canada Border Services Agency stronger powers to detain suspected counterfeit shipments at the border.
Competition Act
The federal Competition Act prohibits false or misleading representations to the public, including selling a product materially different from the one advertised, whether by us or by an unauthorised seller.
Provincial Consumer Protection
Provincial legislation, such as Ontario's Consumer Protection Act, 2002, separately prohibits false representations about the origin, sponsorship or authenticity of goods sold to consumers online.
Trade Marks Act 2002
This Act protects registered trade marks against unauthorised use on identical or similar goods, and provides civil and, in serious cases, criminal remedies for counterfeiting under New Zealand law.
Fair Trading Act 1986
The Fair Trading Act prohibits misleading and deceptive conduct, including false representations about the origin, sponsorship or genuine nature of goods, and is enforced by the Commerce Commission.
Border Protection (Customs)
Trade mark owners can apply to New Zealand Customs to have suspected counterfeit imports detained at the border under the Trade Marks Act's border protection provisions.
Consumer Guarantees Act 1993
Goods supplied to New Zealand customers must match their description and be of acceptable quality. A counterfeit or materially different product would not meet this standard, giving you a right to a repair, replacement or refund from us.
How and when we update this policy
We review this page whenever we add a new product category, appoint an authorised reseller, or when the regulatory position in any of our five markets changes. Material updates are reflected in the date below.
