What this Warranty Disclaimer covers
DAILY VITA LABS is a trading name of URBAN CLOTHING PTY LTD (ABN 78 671 782 111). This Warranty Disclaimer applies to every product currently sold on our store — the Ergonomic Memory Foam Seat Cushion and the Car Seat Cover Towels — and to any future product added to our range unless a different warranty term is stated on that product's own page. It sits alongside, and does not replace, our Refund Policy and Terms of Service. Where this page and the Refund Policy both address a change-of-mind return, the Refund Policy governs; where a manufacturing defect or fault is involved, this Warranty Disclaimer governs.

In addition to your non-excludable statutory rights, we back every order with two specific, time-limited commitments: a 30-day satisfaction window from the date of delivery, and a 90-day limited warranty against manufacturing defects in materials and workmanship. Both start from the date your order is marked as delivered by the carrier.

What we do — and do not — promise beyond the law
Except for the non-excludable statutory consumer guarantees described in the Your Statutory Rights, By Country section below, DAILY VITA LABS and URBAN CLOTHING PTY LTD disclaim all other warranties, express or implied, to the fullest extent permitted by law — including any implied warranty of merchantability and any implied warranty of fitness for a particular purpose beyond the general everyday-comfort and vehicle-interior-protection use described on each product page.
This means that if you intend to use a product for a specialised purpose we have not described — for example, a specific medical, therapeutic, occupational health or commercial application — we make no promise, express or implied, that the product is fit for that purpose, and no warranty claim can be based on it.
In jurisdictions that do not allow the exclusion or limitation of implied warranties, or limits on how long an implied warranty lasts, the above exclusions and the time limits set out in this page apply only to the extent permitted by the law of your jurisdiction, and you may have additional rights that vary from state to state, province to province, or country to country.
What isn't covered by this warranty
The following are not treated as manufacturing defects and fall outside the express warranty described above. They do not affect any statutory consumer guarantee that applies to your purchase by law.
Normal wear and tear
Gradual softening of memory foam, minor fabric pilling, colour fading from sun exposure, or reduced absorbency of the microfibre towel over months of regular use.
Unauthorised repairs or modification
Damage caused by attempted repair, re-stitching, alteration or disassembly by anyone other than DAILY VITA LABS or a repairer we have authorised in writing.
Misuse, abuse or accident
Overloading beyond ordinary seated body weight, submerging the memory foam core in water, exposure to open flame or extreme heat, or using either product for a purpose it was not designed for.
Improper cleaning or care
Damage from bleach, harsh solvents, high-heat tumble drying, dry cleaning, or ignoring the wash-care instructions printed on the product's permanent label.
Third-party products or accessories
Compatibility issues, wear or damage caused by using the item alongside a non-DAILY VITA LABS accessory, aftermarket seat, or a vehicle interior it was not designed to fit.
Missing proof of purchase
Claims made without a valid order number or proof of purchase from DAILY VITA LABS, or made by someone other than the original purchaser, without prior written agreement from us.
How to make a warranty claim
We keep the process simple and handled personally by our own team — no automated ticketing system, no chatbot.
Contact us within the warranty period
Email support@dailyvitalabs.com or call +61 479 095 200 within 30 days (satisfaction guarantee) or 90 days (defect warranty) of the delivery date shown on your shipping confirmation.
Provide your order details and evidence
Include your order number, the email address used at checkout, a clear description of the fault, and clear photos or a short video showing the issue. This lets us assess most claims without needing the item returned first.
We review your claim
Our support team, operated by URBAN CLOTHING PTY LTD, reviews warranty claims within our stated 1–2 business day response window and will let you know what we need next, if anything.
Resolution
Where a claim is approved, we will arrange a free repair, a free replacement, or a refund at our discretion, as described in this Warranty Disclaimer. If we ask you to return the item, we will provide instructions and, for confirmed defects, cover the reasonable cost of return shipping.
How long you have to claim
Time limits differ depending on whether you are relying on our express warranty or on a statutory consumer guarantee that applies to you by law.
Repair, replacement or refund is your remedy under this warranty
Where a claim is validly made under the express warranty set out on this page, your sole and exclusive remedy — and our entire liability — is limited, at our discretion, to the repair of the product, its replacement with the same or an equivalent product, or a refund of the purchase price paid.
To the maximum extent permitted by law, DAILY VITA LABS and URBAN CLOTHING PTY LTD are not liable for any indirect, incidental, special or consequential loss or damage arising from the use of, or inability to use, our products, including loss of time, inconvenience, or damage to a vehicle interior beyond the cost of the product itself.
Nothing in this Warranty Disclaimer excludes, restricts or modifies any consumer guarantee, condition, warranty or right that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law, the Magnuson-Moss Warranty Act and applicable state law in the United States, the Consumer Rights Act 2015 in the United Kingdom, provincial consumer protection and sale of goods legislation in Canada, or the Consumer Guarantees Act 1993 in New Zealand. Where such a law applies, our liability is limited to the fullest extent that law allows, and this section is to be read subject to it.
Your statutory rights, by country
These guarantees exist automatically under law wherever you are shopping from, and they exist independently of the express warranty described above. The summaries below are provided for transparency and general information; they are not a substitute for independent legal advice.
Consumer guarantees (ACL)
Under the Australian Consumer Law, part of the Competition and Consumer Act 2010 (Cth), our products come with guarantees that cannot be excluded: acceptable quality, fitness for the purpose we describe, and matching their description.
A major failure entitles you to choose a refund or replacement; a minor failure entitles us to choose to repair the item within a reasonable time. These rights exist on top of, and are never limited by, the 30-day and 90-day windows described earlier on this page.
No excluding statutory rights
Section 64 of the ACL makes any term that purports to exclude, restrict or modify a consumer guarantee void. This Warranty Disclaimer is drafted to sit alongside these guarantees, not to limit them.
Reasonable durability
The ACL's acceptable quality guarantee includes an expectation of durability appropriate to a comfort accessory at this price point. Our 90-day express defect warranty does not shorten this statutory expectation.
Where to escalate
If a warranty concern cannot be resolved directly with us, you may contact the Queensland Office of Fair Trading (our home state) or, for matters of national scope, the Australian Competition and Consumer Commission (ACCC).
Magnuson-Moss Warranty Act
Our express warranty is written to comply with the federal Magnuson-Moss Warranty Act's disclosure requirements. We designate it a "limited warranty" because it does not cover every possible defect at every point in the product's life, and this page discloses its exact terms, exclusions and duration in plain language.
Implied warranty of merchantability (UCC)
Most US states imply a warranty of merchantability under their adopted version of the Uniform Commercial Code. We do not exclude this guarantee; we only disclaim implied fitness for purposes beyond ordinary seating comfort and vehicle-interior protection, as described above.
FTC Act – Section 5
Warranty claims and advertised coverage are written to be accurate and substantiated, in line with the Federal Trade Commission's prohibition on unfair or deceptive acts or practices, including its guidance on advertising written warranties.
Textile labelling
Fabric components of our seat cushion cover and towel cover are labelled in line with the Textile Fiber Products Identification Act and the FTC Care Labeling Rule, supporting any warranty assessment tied to fibre content or care instructions.
Consumer Rights Act 2015
Goods must be of satisfactory quality, fit for purpose and as described. Within the first 30 days you have a short-term right to reject faulty goods for a full refund; after that, you may be entitled to a repair, replacement, price reduction or the final right to reject.
Six-month presumption
If a fault appears within six months of delivery, it is presumed under the Consumer Rights Act 2015 to have been present at the time of delivery unless we can show otherwise, which supports most warranty claims made in that period.
Furniture & Furnishings Fire Safety
Seating and cushion products supplied for the UK market are considered in light of the Furniture and Furnishings (Fire) (Safety) Regulations 1988; our manufacturing partners are expected to meet the relevant labelling and material requirements for upholstered seating items.
Where to escalate
Unresolved warranty disputes may be referred to the Chartered Trading Standards Institute (CTSI) or a relevant Alternative Dispute Resolution (ADR) body.
Provincial implied conditions
Provincial Sale of Goods legislation implies conditions of merchantable quality and fitness for purpose into every consumer sale. These implied conditions cannot be excluded by this Warranty Disclaimer and apply alongside our 30-day and 90-day express terms.
Provincial consumer protection
Legislation such as Ontario's Consumer Protection Act, 2002 gives additional remedies for undelivered, defective or misrepresented goods, on top of the warranty terms set out here.
Competition Act (Federal)
Our advertised warranty terms are prepared to comply with the misleading advertising provisions of the federal Competition Act, which prohibits performance claims that are not based on adequate testing.
Quebec legal warranty
Under the Consumer Protection Act (Quebec), goods must be fit for the purpose for which they are ordinarily used and durable for a reasonable time considering their price, contract terms and conditions of use — a "legal warranty" that exists independently of, and is never shortened by, our express warranty.
Consumer Guarantees Act 1993
Goods supplied to New Zealand customers are guaranteed to be of acceptable quality, fit for purpose and to match their description. Where a product fails to meet a guarantee, you are entitled to a repair, replacement or refund depending on whether the failure is minor or of a substantial character.
Fair Trading Act 1986
Any warranty claim we make about our products must be accurate and substantiated, in line with the Fair Trading Act 1986's prohibition on misleading or deceptive conduct, enforced by the Commerce Commission.
Cross-border seller disclosure
As an overseas-based online retailer selling into New Zealand, we clearly disclose that this Warranty Disclaimer, our returns process and any associated costs (such as return shipping from New Zealand) apply to cross-border orders in the same way as domestic ones, in addition to the Consumer Guarantees Act.

Unresolved matters may be referred to the New Zealand Commerce Commission or Consumer Protection, part of the Ministry of Business, Innovation & Employment.
