A single, honest place to control your data

DAILY VITA LABS, a registered trading name of URBAN CLOTHING PTY LTD (ABN 78 671 782 111), collects a modest amount of personal information — your name, contact details, delivery address and order history — to process orders for the Ergonomic Memory Foam Seat Cushion and Car Seat Cover Towels, and to run our checkout and marketing systems.

We do not sell your personal information for money, and we do not knowingly share it with third parties for their own advertising purposes. Your Rights, By Country

The privacy law behind each right

Every jurisdiction we ship to gives you a slightly different set of rights and response timelines. These summaries are for transparency and general information — they are not a substitute for independent legal advice.

Privacy Act 1988 (Cth)

Under the Australian Privacy Principles (APPs), you may request access to and correction of your personal information, and object to it being used for direct marketing at any time (APP 7). We aim to respond to a straightforward request within a reasonable period, generally within 30 days.

Spam Act 2003 (Cth)

Every marketing email or SMS we send includes a functional unsubscribe facility, honoured within five business days as required by the Spam Act 2003, regulated by the Australian Communications and Media Authority (ACMA).

Notifiable Data Breaches Scheme

If a data breach affecting your personal information is likely to result in serious harm, we are required to notify you and the Office of the Australian Information Commissioner (OAIC) under the Notifiable Data Breaches scheme.

Escalation

If you're not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at any time.

Queensland-specific: as a business registered and headquartered in Queensland, we handle Queensland residents' requests under the federal Privacy Act 1988, the primary privacy law applicable to our operations.

California (CCPA / CPRA)

California residents may request to know, delete or correct their personal information, and to opt out of the sale or sharing of personal information and the use of sensitive personal information, under the California Consumer Privacy Act as amended by the CPRA. We respond within 45 days, extendable by a further 45 days where reasonably necessary.

Other State Privacy Laws

Residents of states including Virginia, Colorado, Connecticut, Utah and other states with comparable comprehensive privacy statutes have similar rights to access, delete, correct and opt out of targeted advertising or the sale of personal data. This form is the single intake point for a request under any applicable state law.

CAN-SPAM Act

Commercial email is sent with accurate sender information and a working opt-out link, honoured promptly and in any case within 10 business days, as required by the CAN-SPAM Act.

Non-Discrimination Guarantee

We will never deny you goods or services, charge a different price, or provide a different level of service because you exercised a privacy right, as required under the CCPA/CPRA and similar state laws.

State-specific: please tell us your state in the form above so we can apply the correct statutory timeline and rights. If your state isn't listed under a specific comprehensive privacy law, we will still process your request in line with our general privacy commitments and the FTC Act.

UK GDPR

You have the right to access, rectify, erase, restrict, or object to the processing of your personal data, and the right to data portability, under the UK General Data Protection Regulation. We respond within one calendar month, extendable by two further months for complex requests, with notice to you of any extension.

Data Protection Act 2018

The Data Protection Act 2018 supplements the UK GDPR domestically, including the right to object to direct marketing at any time — a request we action without delay.

PECR

Electronic marketing complies with the Privacy and Electronic Communications Regulations (PECR), meaning we only market to you with consent and provide a clear opt-out in every message.

Escalation

If you're not satisfied with our response, you may complain to the Information Commissioner's Office (ICO), the UK's independent data protection regulator.

Region-specific: these rights and timelines apply consistently across England, Scotland, Wales and Northern Ireland.

PIPEDA (Federal)

Under the Personal Information Protection and Electronic Documents Act, you may request access to and correction of your personal information, and withdraw consent for its use, subject to legal or contractual restrictions. We respond within 30 days.

Quebec's Law 25

Residents of Quebec have additional rights under the province's Act respecting the protection of personal information in the private sector (Law 25), including the right to request de-indexing and to receive clearer information about automated decision-making.

CASL (Anti-Spam Legislation)

Commercial electronic messages comply with Canada's Anti-Spam Legislation (CASL); an unsubscribe request is honoured within 10 business days of receipt.

Escalation

If you're not satisfied with our response, you may complain to the Office of the Privacy Commissioner of Canada or, for Quebec residents, the Commission d'accès à l'information du Québec.

Quebec-specific: please note "Quebec" as your province in the form above so we can apply Law 25's additional protections and timelines to your request.

Privacy Act 2020

Under the Privacy Act 2020 and its Information Privacy Principles, you may request access to and correction of your personal information. We respond within 20 working days, as required by law.

Unsolicited Electronic Messages Act 2007

Commercial electronic messages comply with the Unsolicited Electronic Messages Act 2007, requiring consent, accurate sender details and a functional unsubscribe option in every message.

Cross-Border Data Transfer

As an overseas-based retailer, we take reasonable steps to ensure your personal information receives comparable protection when it is processed outside New Zealand, consistent with Information Privacy Principle 12.

Escalation

If you're not satisfied with our response, you may complain to the Office of the Privacy Commissioner, New Zealand's independent privacy regulator.

Unresolved matters may be referred to the Office of the Privacy Commissioner or, for advertising-related complaints, the Advertising Standards Authority.

Some data must be kept

Tax, accounting and consumer-guarantee law in every country we operate in requires certain order records to be retained for a set period, even after a deletion request — we'll explain exactly what and why if this applies to you.
