Terms of Service
These Terms govern every visit to dailyvitalabs.com and every order for the Ergonomic Memory Foam Seat Cushion or Car Seat Cover Towels. Written in plain English rather than copied boilerplate, they set out how orders, payment, shipping, returns and refunds work, what you can expect from us, and your consumer rights under the law of Australia, the United States, the United Kingdom, Canada and New Zealand.
Who you are contracting with
DAILY VITA LABS is a registered trading name of URBAN CLOTHING PTY LTD, an Australian-registered company. Wherever these Terms say "we", "us" or "DAILY VITA LABS", it means URBAN CLOTHING PTY LTD trading as DAILY VITA LABS. By browsing dailyvitalabs.com or placing an order, you enter into a direct contract with URBAN CLOTHING PTY LTD on the terms set out below.
These Terms apply to dailyvitalabs.com, to any purchase of the Ergonomic Memory Foam Seat Cushion or Car Seat Cover Towels, and to any other interaction you have with us. They should be read alongside our Privacy Policy, Shipping Policy and Return & Refund Policy, which form part of the contract between us.
Accepting these Terms
By browsing our store, creating an account, or placing an order, you confirm that you accept these Terms in full. If you do not agree with any part of these Terms, please do not use dailyvitalabs.com or place an order.
Who can order
You must be at least 18 years old, or the age of legal majority in your place of residence, and have the legal capacity to enter a binding contract, to place an order with us. If you are ordering on behalf of a business, you confirm you have authority to bind that business.
Accurate information
You agree to provide current, complete and accurate information when ordering, including your name, delivery address, contact details and payment details, and to keep any account information up to date.
Optional accounts
You may check out as a guest or create a customer account. If you create an account, you are responsible for keeping your login credentials confidential and for all activity under your account.
Changes to these Terms
We may update these Terms from time to time, as described in the Changes section below. The version in force at the time you place an order is the version that applies to that order.
Our products, descriptions and pricing
Our current range is two physical comfort products: the Ergonomic Memory Foam Seat Cushion and Car Seat Cover Towels. We describe both as accurately as we can, including materials, dimensions and intended use, and we photograph our actual products rather than stock imagery wherever possible.
Product descriptions
We take reasonable care to ensure descriptions, dimensions and images are accurate. Minor variations in colour, due to screen display differences, and reasonable manufacturing tolerances in size are not considered a fault.
Pricing and currency
All prices are displayed and charged in Australian dollars (USD). If you are paying from outside Australia, your card issuer or payment provider may apply its own currency conversion and any associated fee, which is outside our control.
Pricing errors
If a product is listed at an incorrect price due to a typographical, technical or supplier error, we will contact you before dispatch to confirm whether you wish to proceed at the correct price or cancel for a full refund. We are not obliged to honour an obviously incorrect price.
Stock availability
Products are offered subject to availability. If an item you have ordered is unexpectedly out of stock, we will notify you promptly and offer a full refund or the option to wait for restock.
How an order becomes a contract
You place an order
Adding an item to your cart and completing checkout is an offer by you to buy that product on these Terms, not an acceptance by us.
We confirm your order
We send an automatic order confirmation email once payment is authorised. This confirms we have received your order; a binding contract is formed when we dispatch your order or send you a dispatch confirmation, whichever happens first.
We may decline or cancel an order
We may refuse or cancel an order, in whole or part, before dispatch where a product is unavailable, a pricing or listing error occurred, we suspect frUSD or an unauthorised transaction, or the delivery address falls outside the countries we serve. Where we cancel an order you have paid for, we will refund it in full.
Changing or cancelling your order
Contact us as soon as possible at support@dailyvitalabs.com if you need to change or cancel an order. We can usually amend or cancel an order free of charge before it has been packed; once an order has been packed or dispatched, our standard Return & Refund Policy applies instead.
Payment methods
Full payment is taken at the time you place your order, processed securely through Shopify's PCI DSS-compliant payment infrastructure. We accept the following methods, shown at checkout:
We never see or store your full card number; card and digital wallet payments are handled entirely by Shopify's payment infrastructure and the relevant network or wallet provider. If a payment is declined, please check your details or contact your card issuer; we cannot see the reason a payment was declined on our end.
Shipping, in summary
We ship from Queensland, Australia to Australia, the United States, the United Kingdom, Canada and New Zealand only. Full detail, including customs and import duty obligations, is set out in our Shipping Policy, which forms part of these Terms.
Order cut-off
4:00 pm AEST (GMT+10:00), Monday to Friday. Orders after this time begin processing the next business day.
Processing time
1–3 business days (Monday–Friday) before your order is handed to the carrier.
Standard Shipping
Free on every order. Estimated transit: 7–15 business days.
Express Insured Shipping
Flat rate of USD $6.00. Estimated transit: 5–8 business days, fully insured against loss or damage in transit.
Returns, refunds and cancellations
We offer a straightforward 30-day change-of-mind return window in addition to your non-waivable statutory consumer rights, described in the Rights By Country section below.
30-day return window
You may return the Ergonomic Memory Foam Seat Cushion or Car Seat Cover Towels within 30 days of delivery, whether you have simply changed your mind or the item is faulty, provided the item is unused, in its original packaging and condition where reasonably possible.
10-business-day refund
Once your return is received and inspected, we process your refund to your original payment method within 10 business days. Your bank or card provider may take additional time to display the refund in your account.
Faulty or incorrect items
If your order arrives faulty, damaged or different from what you ordered, contact us and we will arrange a replacement, repair or refund in line with the consumer guarantees applicable in your country, at no cost to you.

Intended use and product safety
Both of our products are general comfort accessories. Please read the following before use, as it affects how each product is intended to be used.
Ergonomic Memory Foam Seat Cushion
Intended as a general comfort and posture-support accessory for use on office chairs, dining chairs and similar seating. It is not a medical device, is not intended to diagnose, treat, cure or prevent any medical condition, and does not replace advice from a qualified healthcare professional regarding back, hip or posture-related conditions.
Car Seat Cover Towels
Intended solely as a protective, absorbent cover placed over an existing adult vehicle seat, to protect upholstery from moisture, sand, sweat or general wear. It is not a child restraint, booster seat or car seat replacement, is not designed or certified to any child passenger safety standard, and must never be used in place of, or in a way that interferes with the correct fitting or function of, a properly installed child car seat, booster seat or seatbelt in any of the countries we ship to.
General use disclaimer
You are responsible for using both products only for their intended purpose, in accordance with any care instructions included with your order, and for supervising use by children where relevant. Nothing in this section limits any consumer guarantee that cannot lawfully be excluded under the law described in the Rights By Country section below.
Intellectual property
All content on dailyvitalabs.com, including our name, logo, product photography, written descriptions, and site design, is owned by or licensed to URBAN CLOTHING PTY LTD and is protected by copyright, trade mark and other intellectual property laws in Australia and internationally. You may view, download and print pages from our site for your own personal, non-commercial use. You may not reproduce, republish, sell or otherwise exploit any part of our site or its content for commercial purposes without our prior written consent.
Acceptable use of our store
When using dailyvitalabs.com, you agree not to:
Use our store for any unlawful purpose, or in a way that breaches any applicable law or regulation in your country.
Attempt to gain unauthorised access to our systems, place frUSDulent orders, or use a stolen or unauthorised payment method.
Interfere with the security or normal operation of our site, including by introducing malicious code or attempting to overload our infrastructure.
Scrape, harvest or reuse our product data, pricing or images for a competing commercial purpose without our consent.
We may suspend or refuse service to any customer we reasonably believe has breached this section, including cancelling pending orders, without affecting any consumer right you may otherwise hold.
Warranties, liability and indemnity
Nothing in this section excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law, or the equivalent mandatory consumer protection law of the United States, the United Kingdom, Canada or New Zealand described in the Rights By Country section below. Where any such right applies, it prevails over this section.
Our store, as provided
To the extent permitted by law, our store and its content are provided on an "as is" and "as available" basis. We do not guarantee our site will be uninterrupted, error-free or free of viruses.
Limitation of liability
To the extent permitted by law, our total liability to you for any claim arising from your order is limited to the amount you paid for the relevant product, and we are not liable for indirect, incidental or consequential loss.
Your indemnity to us
You agree to indemnify us against reasonable losses arising from your breach of these Terms, your misuse of a product outside its intended purpose described in the Product Use & Safety section, or your unlawful use of our store.
Force majeure
We are not liable for any delay or failure to perform caused by events outside our reasonable control, including natural disaster, extreme weather, carrier disruption, customs delay, or industrial action.
Third-party services and links
Our store runs on the Shopify platform and uses third-party payment processors, shipping carriers, and, where enabled, analytics or advertising tools, each with their own terms and privacy practices, as described in our Privacy Policy. Our site may occasionally link to third-party websites for your convenience; we do not control and are not responsible for the content, accuracy or practices of any site we do not operate.
Governing law and your local rights
These Terms, and any contract formed when you place an order, are governed by the laws of Queensland, Australia, without regard to conflict-of-law principles, and we both submit to the non-exclusive jurisdiction of the courts of Queensland, Australia.
This does not remove your local consumer protections
If you are a consumer resident in the United States, the United Kingdom, Canada or New Zealand, choosing Queensland, Australia as the governing law does not deprive you of the protection of any mandatory consumer protection provisions of the law of your own country that cannot be excluded by agreement. Those rights, summarised in the Rights By Country section below, continue to apply to you alongside these Terms.

Australia
Australian Consumer Law
Our goods come with guarantees under Schedule 2 of the Competition and Consumer Act 2010 (Cth) that cannot be excluded, including that they are of acceptable quality, fit for purpose and match their description. You are entitled to a replacement or refund for a major failure, and compensation for reasonably foreseeable loss.
Misleading conduct
Section 18 of the Australian Consumer Law prohibits misleading or deceptive conduct; our product claims, pricing and shipping representations are accurate to the best of our knowledge.
Queensland-specific
As a business registered and headquartered in Alexandra Hills, Queensland, we handle all Australian contract disputes under the federal Australian Consumer Law, the primary law applicable nationwide.
Escalation
If a dispute is not resolved directly with us, you may contact the Queensland Office of Fair Trading or the Australian Competition and Consumer Commission (ACCC).
United States
Uniform Commercial Code & Magnuson-Moss
Sale of goods to US consumers is generally governed by the Uniform Commercial Code as adopted in your state, and any written warranty representations we make are subject to the Magnuson-Moss Warranty Act.
FTC Act & Mail Order Rule
The Federal Trade Commission Act prohibits unfair or deceptive practices, and the Mail, Internet, or Telephone Order Merchandise Rule (16 CFR Part 435) governs the shipping timeframes described in our Shipping Policy.
State consumer protection laws
Individual states, including California, New York and others, maintain their own consumer protection and unfair trade practice statutes, which apply according to your state of residence in addition to federal law.
Dispute resolution
Nothing in these Terms prevents a US consumer from bringing a claim in a small claims court of competent jurisdiction where permitted by their state law.
United Kingdom
Consumer Rights Act 2015
Goods supplied to you must be of satisfactory quality, fit for purpose and as described. If they are not, you are entitled to a repair, replacement, price reduction or refund, depending on how long you have had the goods.
Consumer Contracts Regulations 2013
You generally have a 14-day statutory right to cancel an online order for any reason, running in addition to, and not instead of, our own 30-day return window. We must give you clear pre-contract information, which we do at checkout and in these Terms.
Unfair Contract Terms
Under the Consumer Rights Act 2015, a contract term or notice will not bind you to the extent it is found to be unfair; we do not seek to rely on any term in a way that would be unfair to a UK consumer.
Escalation
If a dispute is not resolved directly with us, you may seek advice from Citizens Advice or the Competition and Markets Authority. These rights apply consistently across England, Scotland, Wales and Northern Ireland.
Canada
Provincial consumer protection statutes
Laws such as Ontario's Consumer Protection Act, 2002, and equivalent statutes in other provinces and territories, provide remedies for internet sales that are not as represented and may imply warranty conditions we cannot exclude for consumer purchases.
Competition Act (federal)
Prohibits false or misleading representations in promoting a product across Canada, including our pricing, shipping and return claims.
Quebec
Under Quebec's Consumer Protection Act, consumer contracts must generally be drawn up in French unless the consumer expressly wishes to receive them in another language. If you are a Quebec resident, you may request a French-language version of these Terms by contacting us.
Escalation
Complaints can be raised with your provincial consumer protection office or the Competition Bureau of Canada.
New Zealand
Consumer Guarantees Act 1993
Our goods come with guarantees that cannot be contracted out of for consumer purchases, including that they are of acceptable quality and fit for purpose. If a guarantee is not met, you are entitled to a repair, replacement or refund.
Fair Trading Act 1986
Prohibits misleading or deceptive conduct and false representations about goods, including their price, benefits and delivery, in trade.
Contract and Commercial Law Act 2017
Governs the formation and interpretation of sale-of-goods contracts in New Zealand, alongside the consumer guarantees above.
Escalation
Complaints can be referred to the Commerce Commission or Consumer Protection, part of New Zealand's Ministry of Business, Innovation and Employment.
Changes to these Terms
We may update these Terms from time to time as our product range, service providers or the law change. The "last updated" date at the top of this page always reflects the current version, and the version in force at the time you place an order applies to that order.
If any provision of these Terms is found to be unenforceable or invalid under any applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
